From 1 June 2025, the following new provisions of the Maternity Protection Act will come into force for women who suffer a miscarriage from the 13th week of pregnancy:
Gradual maternity protection after a miscarriage
This varies depending on the progress of the pregnancy. Unless the woman specifically requests it, she does not have to work during this time.
- 13th – 16th week of pregnancy: 2 weeks of maternity leave
- 17th – 19th week of pregnancy: 6 weeks of maternity leave
- from the 20th week of pregnancy: 8 weeks of maternity leave
Entitlement to maternity benefits
During this period, the women concerned are entitled to maternity benefits without the need for a medical certificate.
Retroactive protection against dismissal
The protection against dismissal also remains in effect retroactively if the employer was informed about the pregnancy.
