With the judgment of March 28, 2025 (Case No. V ZR 185/23), the Federal Court of Justice decided that there is no general height limit for hedges. The decisive factor for classification as a hedge is the external appearance and the closed impression of the plantings. For hedges planted on higher-lying properties, the permissible hedge height is measured from the point where the plants emerge from the ground, unless the property level has been artificially raised, in which case the original ground level is decisive.
