Immediate Termination Due to Prolonged Showering and Bathing as well as Vacuuming and Moving Furniture at Night

Regular showering and bathing for a duration of one to three hours, as well as vacuuming and moving furniture at night, justifies immediate termination of the rental agreement if the behavior continues despite warnings. This was decided by the Hamburg District Court in a ruling on February 11, 2025.

In the Hamburg case, the tenant persistently disturbed the nighttime quiet hours and thus the peace of the house within the meaning of § 569 Abs. 2 BGB and violated the mutual duty of consideration through their behavior, as the noise associated with these activities far exceeds the usual and acceptable level in a multi-family house. Prolonged showering and bathing, as well as vacuuming and moving furniture at night, is not normal residential behavior.
